Kid Wonder Pty Limited (Kidwonder) is a corporation existing under the law of the State of New South Wales and Australia with ABN 11 658 291 788.
Kidwonder’s Website and domains, including www.kidwonder.com, and all of the webpages, subdomains, country level domain variants and subparts of the Website, are collectively referred to within this Terms of Use as “Website”.
By accessing and using this Website you agree to abide by the following Terms & Conditions, the Privacy Policy, and any additional terms and conditions displayed or linked on the Website. If you do not agree to these Terms & Conditions, please discontinue using this Website. Kidwonder may refuse any order to purchase a product or deny access to the Website for any conduct it believes may breach these Terms & Conditions.
In these Terms of Use:
i) the terms “Content” and “we”, “us”, “our”, or “Kidwonder” refer to the material available on this Website, including text, graphics, logos, audio, and software;
ii) the term “User Content” refers to any user-generated content, such as audio, video, images, information, or other non-personal content.
1. Use of this Website
You agree to use the Website solely for personal, non-commercial purposes and agree to the following:
a) Refrain from using the Website for any commercial activities not endorsed or approved by Kidwonder.
b) Avoid engaging in defamatory, abusive, threatening, or distributing harmful material, including obscene, indecent, unlawful, defamatory, libellous, or racist content.
c) Do not use the Website to obtain or distribute unsolicited emails or communications to other users or third parties.
d) Only upload or post personal content and refrain from uploading or posting any content that contains nudity or depicts obscene, lewd, violent, harassing, sexually explicit, or objectionable subject matter.
e) Do not upload or post any content that promotes or provides instructions for criminal offences or any other lawful activities.
f) Do not upload or post content that violates the rights of any party, including intellectual property rights, confidentiality, privacy, or any local, state, national, or international laws. h) Do not upload or post any material that is encrypted, constitutes junk mail or unauthorised advertising or commercial offers.

a) You acknowledge that Kidwonder may or may not pre-screen Content or User Content, and we have the right (but not the obligation) to pre-screen, refuse, or remove any Content or User Content provided by you.
b) We may edit, remove, or withhold publication of any Content or User Content if it is deemed unlawful, false, misleading, infringing intellectual property rights, abusive, offensive, obscene, or in breach of these Terms and Conditions.
c) While we may occasionally monitor or review Content and User Content, discussions, chats, postings, or other contributions on the Website, we are not obligated to do so, and we assume no responsibility or liability for the contents of such communications or any errors, defamation, libel, obscenity, profanity, or inaccuracies they may contain.
3. Minimum Age Requirements
You confirm that you are at least 13 years old or if you are under the age of 13, you are accessing this Website under parental or guardian supervision.
4. Intellectual Property and Use of Content
Unless stated otherwise in these Terms of Use, we hold ownership or licences to all rights, title, and interest (including copyright, designs, patents, trademarks, and other intellectual property rights) in the Content.

5. Consents
Permissions granted to Kidwonder:
The Websites are interactive and public, and by uploading, posting, or submitting User Content to the Website, you grant us certain permissions and consents to use your User Content. For example, if Kidwonder is tagged by you in a social media post, you are consenting Kidwonder to using your User Content. If we choose to re-share and post on our social media channels, it may appear on our Websites as they may have direct and live access to Kidwonder social media channels.
You consent to and grant us a non-exclusive, royalty-free, worldwide, revocable, non-transferable, perpetual licence to use, modify, adapt, delete from, add to, publicly display, reproduce, distribute, and communicate your User Content as we see fit. This includes the right to make your User Content available to third parties on any terms and for any reason. It also includes the editing, compiling, and assembling of video works, interstitials, or the use of photographic works as underlying works compiled into moving images, without limitations, in various online media formats (including e-newsletters) and through social media channels, pages, or accounts. If your User Content has moral rights, you consent to us performing any act that, without this consent would infringe upon those moral rights.
Kidwonder does not claim ownership or copyright of your User Content.
If your User Content is used on Kidwonder’s digital or social platforms, we will always credit your name and/or business. We may also, at our sole discretion, choose to include links back to your website or business social media profile.
You have the right to revoke the above-mentioned licence of consents at any time by contacting Kidwonder in writing at info@kidwonder.com and informing us that you no longer want us to use your User Content.

Conditions of Entry
Effective Date: 3rd August 2023
The safety, security and enjoyment of our visitors and staff are of paramount importance to Kidwonder. By entering any Kidwonder Premises, whether it be a permanent venue, a temporary pop-up or an exhibition hosted within an existing establishment or venue, each person agrees to be bound by the following Conditions of Entry. Compliance will help Kidwonder to create a safe environment for all visitors.
1. Definition
In the Conditions of Entry, “Premises” refers to any physical locations, facilities, or properties owned, managed or controlled by Kid Wonder Pty Limited (“Kidwonder”, “we”, “our” or “us”). These locations may include a permanent venue, a temporary pop-up in a public area, exhibitions hosted within an existing establishment or venue, or any other premises associated with Kidwonder’s activities and services.
When the Premises refers to exhibitions hosted within an existing establishment or venue, there may also be a requirement to comply with the existing establishment or venue’s own conditions of entry.
“Children” refers to any individual under the age of 18 years.
2. Conditions
Whenever you are on Kidwonder Premises, it is a requirement that you:
- • conduct yourself responsibly and in a manner which, in the reasonable opinion of the Kidwonder, does not interfere with, disrupt or offend other persons on the Premises;
- • comply with any rules or policies, established by Kidwonder;
- • comply with any reasonable requests by Kidwonder staff or signage in relation to your entry or continued presence on the Premises;
- • wear appropriate clothing and footwear at all times which will protect you against injury; and
- • at all times, supervise children (including school students) under the age of 18, for whom you are responsible and ensure that they do not breach any of these Conditions of Entry.
It is a requirement that you do not:
- • use tripods, flash or lighting equipment without the express permission of Kidwonder;
- • use any images or recording captured by you for any commercial application without a formal written agreement with Kidwonder in place;
- • smoke (including the use of e-cigarettes) on the Premises, indoors or outdoors;
- • bring or consume alcoholic beverages on the Premises;
- • bring or consume outside food as a safety precaution;
- • eat or drink in artwork display areas or other areas where this is restricted; and
- • bring animals onto the Premises with the exception of registered service animals.
Kidwonder reserves the right to:
- • exclude or remove guests from the Premises for non-compliance with the Conditions of Entry, in which case tickets will not be exchanged or refunded unless required by law;
- • inspect any bag, luggage or objects upon entry to and before leaving the premises;
- • use security closed-circuit television cameras throughout the premises for the security and safety of our guests and team;
3. Photography and Videography on Premises
While photography and videography is allowed on Kidwonder Premises for personal use and enjoyment, the following guidelines must be adhered to to ensure child safety and respect the privacy of all individuals.
- • Consent: Obtain explicit consent from parents or guardians before capturing any images or videos of children other than children under your own supervision.
- • No Inappropriate Content: Refrain from capturing or sharing any content that could be considered inappropriate, offensive, or harmful to children or any other individuals present in the venue.
- • Respect Personal Space: Maintain a reasonable distance from children and other individuals, and avoid intruding on their personal space while taking photographs or recording videos.
- • No Identifying Information: Avoid including any identifying information, such as full names, school names, in captions or descriptions when sharing images or videos online.
- • Monitoring and Supervision: Activities on Kidwonder premises will be monitored and supervised by staff and by means of CCTV, especially when involving minors, to prevent any potential misuse of images or videos.
- • Reporting: Report any suspicious or concerning behaviour to staff immediately. • Compliance with laws: Comply with all applicable laws and regulations related to photography, child safety, and privacy rights.
By following the above guidelines, we can create a safe and enjoyable environment for everyone within the Kidwonder Premises while capturing cherished memories or content.
Kidwonder will at times, capture images and recordings to be used for Kidwonder marketing purposes. While on the premises, you consent to being photographed, filmed or recorded during your visit for any such film, image or recording at Kidwonder’s discretion.
4. Risk Waiver, Damage & Liability
By purchasing a ticket and entering the Premises you acknowledge and agree to the below conditions.
- • You enter the Kidwonder Premises at your own risk.
- • You understand that attendance may carry with it certain dangers, including the risk of injury, injury to those in your care, damage to you, damage to those in your case and damage to your property and the property of those in your care.
- • By attending the Premises you accept the risk of damage or loss (including property damage, personal injury, economic and consequential loss) however arising (including negligence). This includes damage or loss caused by acts or omissions of other guests, and the employees and agents of Kidwonder.
- • It is the sole responsibility of the parent or guardian to supervise children at all times and be aware of your surroundings at all times.
- • Kidwonder does not accept responsibility for injury (physical and/or mental) arising from:
- - incorrect usage of equipment;
- - non-compliance with established instructions, rules and policies on the Kidwonder premises; or
- - non-compliance with the reasonable requests of Kidwonder staff or signage.
- • Kidwonder is not liable and does not accept responsibility to mediate guest interactions.
- • Guests will be liable for costs associated with any damage the individual or the children under their supervision incur to the Kidwonder Premises.
- • Kidwonder is not liable for any lost or stolen belongings. However, requests for CCTV footage for Police reports are to be provided by request and at management’s discretion.
5. Limitation of Liability
To the extent permitted by law, Kidwonder are not liable to you, or those in your care, for any loss, damage, injury, delays, additional expenses or inconvenience arising as a result of your attendance or non-attendance at a session or event. Where liability cannot be excluded or modified by law, including pursuant to the Australian Consumer Law, the liability of Kidwonder is limited to the minimum permitted by law.

Kidwonder may update the Conditions of Entry periodically to reflect changes in our practices or legal requirements. The policy and the date of update is available on the Kidwonder website.
